This is the second edition of this book. Like the first, the purpose is to organize and expand on the many articles I have written during my years as Arizona Association of REALTORS® legal counsel. The book is intended to be a reference for REALTORS®, other real estate practitioners and attorneys involved in the industry to help address everyday legal and practical real estate issues. My intention is to answer frequently asked questions about Arizona real estate law and the real estate forms provided by the association, so those in the industry can better serve their clients and customers. Whether you are drafting a contract, entering into an employment agreement, managing a transaction, or teaching another, this book is intended to be an easy reference for subjects involving the practice of real estate. The many references to case law, statutes and rules are included for the attorneys and others who may want to undertake further research on an issue. If you are new to the industry, my hope is that this book is a helpful resource as you gain experience. If you are a “seasoned” practitioner, my hope is that you can use the book as a reference to answer day-to-day questions.
